Learning about the Fox news lawsuit got me thinking about the rights and protection that we actually have. I mean if it is so difficult for such a big company such as fox to defend its name imagine an individual. I mean is it really that easy for anyone to say things about you whether they are true or not without a penalty? I understand that the freedom of of speech is a right but when is it considered libeling? Like in the case we saw today Franken called one of the spokespersons from fox news a liar and got out scratch free. To me there is nothing more offensive and defaming than someone calling me a liar in front of everyone.

Yeah but Bill O'Reilly (the guy from Fox who was called a liar) is notorious for lying on television. Fox news in general is notorious for being extremely right sided so they tend to put out a lot of information that is not necessarily true and that is extremely biased. Franken was criticizing them among other notorious republicans but in a satirical way.
ReplyDeletewell he's not necessarily a notorious liar but hes famous for being extremely biased and lot of his information is not completely accurate or doesn't tell the full truth
ReplyDeleteSo maybe I chose a bad example but I mean say he was completely honest suppose everything he(O'Reilly) said was true, and someone just came out and called him a liar. I m pretty sure that no matter how clean his reputation is with one person causing controversy it will most definitely smudge your name.
ReplyDeleteJose, that is exactly why we have libel and slander laws... to protect honest people from unethical people who may try to libel or slander them. Lots of celebrities have sued and won magazines line STAR and ENQUIRER for libel. :-) In the case of Franken v Fox, Bill O'Reilly, as Madi put it, was known for being biased and Franken, as a comedian, was known for satirizing people. SO the intention of Franken was never to actually inflict damage. Whereas people whose motivation or callous disregard results in people's reputations being damaged can actually be sued and lose.
